In dismissing the Plaintiff’s claim, the Court Held as follows:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""> <i>“I have looked at the pleadings of the parties after <o:p></o:p></i></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">investigating the evidence and considered the issue <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">whether or not there is a subsisting judgment in which<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif""> the issues raised in this instant action have been <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">conclusively and effectively dealt with by Ansah J.<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif""> (as he then was). <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">I have found as a fact that indeed Ansah J. had <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">determined the issues raised in the 23<sup>rd</sup> January 1993 <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">judgment in suit No LS.4/88. It will therefore be <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">unproductive to go on to consider the issues raised <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">all over again. I am aware that full evidence was led <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">in this case. But there is robust evidence which operates <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">as estoppel per rem judicatam against the plaintiff from <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">re-litigating the flames of a litigation which has been <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">concluded over 17 years ago.
