In the said decision, the court entered judgment in favour of the plaintiff against the defendant for the reliefs endorsed on the writ of summons and assessed ¢5m cost in favour of the plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">Dissatisfied with the decision of the court, the defendant appealed to this court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The Grounds of appeal are;<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">[i] The judgment is against the weight of evidence,<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">[ii] The learned trial judge was wrong in holing that, the plaintiff had lawfully acquired plot No.2 Block 1 Suame, north.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">[iii] The learned judge was wrong in holding that Opanin Kwadwo Krah never acquired any interest in any of the plots in dispute<i> <o:p></o:p></i></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">[iv] The trial judge was wrong in holding that he believed that Opanin Kwadwo Krah was only a caretaker of the property in dispute on behalf of khaled captan.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">[v] The trial court was wrong in holding that nobody indicated to the court that khaled captan was dead and that it was not suggested to the plaintiff under cross examination that the allege donor of the power of attorney wad dead.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">[iv] Additional grounds to be filed upon receipt of the record of proceedings.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> </span></span><!--[endif]--><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">An order allowing the appeal.<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Before dealing with the arguments in support or against this appeal, I will like to give a brief background of this case.<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The plaintiff by his writ of summons claims the following reliefs against the defendant;<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[a] declaration that the plaintiff is the lawful owner of plot No.2 Block 1 with buildings thereon situate lying and being at Suame North Zone, Kumasi.<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[b] An order for vacant possession of the said plot No.2 Block 1, Suame North Zone, Kumasi.<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[c] General damages for trespass.<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify;text-indent:.75pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[d] Perpetual injunction restraining defendant, his agents, heirs, privies, personal representatives and workmen from interfering with plaintiff’s quite enjoyment of the said plot No.2 Block 1, Suame North, Kumasi.<o:p></o:p></span></p><p class="MsoListParagraph" style="margin-left:0in;text-align:justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In his 22 paragraph statement of claim the plaintiff avers among other things that he had information that the disputed property was being offered for sale. He made enquires about the said information which led him to the owners of the plot, the children of the late Opanin Kwadwo Krah [deceased] and the executors of the Will of the late Kwadwo Krah. He avers further that after a lengthy discussion and negotiations with the owners of the plot, they offered the plot for sale at the price of ¢5m which he accepted. The plaintiff continues that, he demanded to see the documents on the land before payments, but his vendors
