They were elected into office in the year 2006 for a term of 4 years pending the enactment and promulgation of the Constitution of the (Ghana National Association of Garages) Association to govern the activities of the said Association. The Association subsequently enacted and promulgated its National Constitution on 15<sup>th</sup> November 2007 which contained transitional provisions.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">It is the case of the Plaintiffs that whilst they were in office discharging their lawful duties and responsibilities as expected of them, the Defendants unlawfully and forcibly constituted themselves into an Interim Management Committee (IMC) of the Association and have since March 2009 locked them out of the office. The Plaintiffs reported the illegal conduct of the defendants to the National Secretariat of the Association which after deliberations on the matter found against the Defendants and consequently directed the Defendants to quit the office. In a letter dated 14<sup>th</sup> August 2009, the National Executive Committee of the Association wrote to Nana Tafohene of Kumasi to intervene in the matter. In the said letter the National Secretariat stated that the Defendants were not recognized by the National body. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">But despite the several attempts to get the defendants out of the office they had continued to unlawfully occupy same. The refusal of the plaintiffs to call for fresh elections led to agitations among the rank and file of the members of the Association which necessitated the Zonal Executives to form an IMC to run the Association upon a call from the members.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The Plaintiffs filed a Motion on Notice for an order of interim injunction accompanied by an affidavit in support and a statement of case. The defendants opposed the application and filed an affidavit to that effect accompanied by exhibit DR1
