The said judgment was delivered on the 22<sup>nd</sup> day of October 2008. In its judgment the trial High Court dismissed the Plaintiff’s claim giving cause to this appeal filed on the 19<sup>th</sup> January 2009.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The brief facts of the case are that the predecessor of the plaintiff namely Kobina Domeyeh sold two parcels of land, adjacent to each other to one Yaw Nyarko the husband of the 1<sup>st</sup> defendant; and one Andrews Kweku Keelson in the years 1981 and 1971 respectively. Andrews Kweku Keelson resold his plot of land to the 2<sup>nd</sup> defendant in 1983. A new road was constructed along the area where defendants had their lands. This resulted in a parcel of land in front of defendants’ land, which land the plaintiff claimed belonged to his family, the Yego Family of Agona Swedru, to which the original vendor of defendants Kobina Domeyah, at the time of sale was the head.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">Issues were joined on these facts and at page 9 of the record of appeal appeared the directions for the trial. What are these flaws? Firstly at page 60 of the record the plaintiff announced the end of his case. This was on the 12<sup>th</sup> of March, 2008. Then the defendants announced the end of their case on the 2<sup>nd</sup> April, 2008. This is at page 64 of the record of appeal. The court then adjourned the case to the 29<sup>th</sup> May 2008 for judgment and ordered addresses to be filed by the 9<sup>th</sup> May, 2008.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua&
