The facts relied on by the parties to establish their respective claims were not complicated. The plaintiff’s case was that he was employed by the defendant as a machine operator. The plaintiff averred that on 28<sup>th</sup> day of October, 2004, the defendant’s agent, Engineer Prosper Afifoe instructed him to assist the chief machine operator to repair a faulty machine. In the course of carrying out defendant’s instruction, the middle finger of his left hand got crushed by the machine. This resulted into amputation of the said finger at the 37 Military Hospital. He contended that he sustained the injury due to the negligence of the defendant and gave the particulars of negligence as follows:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;text-indent: -.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">“a Instructing plaintiff to repair a machine which he was not trained to repair.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;text-indent: -.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></i></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;text-indent: -.5in;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">b Failure to provide safe system of work and adequate security/supervision.”<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">For their part, the defendant, a limited liability company registered in Ghana to do business resisted the plaintiff’s claim by the amended statement of defence filed on 13<sup>th</sup> July, 2006.
