DORDZIE, JA <o:p></o:p></span></b></p><p class="MsoNormal" style="margin-left:2.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The background to the dispute between the parties culminating in this appeal before us is that on 31st of January 2005 the plaintiff respondent herein issued a writ against the defendant appellant in the High Court Accra seeking the following reliefs: (for the purposes of clarity I will in this judgment refer to the parties simply as plaintiff and defendant).<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> 1. Declaration of title to a piece of land measuring 0.27 of an acre situate at Osu<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> 2. General damages for trespass<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> 3. Perpetual injunction restraining the defendant his servants, agents, assigns and anybody claiming through him from further trespassing on the land in dispute. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:2.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The defendant who claims he validly purchased the land before the sale to plaintiff counter claimed for: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">a) Declaration of title to the same land. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">b) An order cancelling the land certificate N0. GA 16774 issued to the plaintiff by the Land Title Registry on grounds of fraud or mistake.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> c) Perpetual injunction restraining the plaintiff; her assigns workmen, servants and agents from interfering with the land.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:2.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> On the 15th of May 2009 the High Court gave judgment in favour of the plaintiff granting all the reliefs sought and dismissed the appellant’s counterclaim.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:2.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> The appellant dissatisfied with the decision of the High Court appealed against the said judgment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:2.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The facts of the case are as follows: The plaintiff through an agent called Debrah purchased the disputed land from one Elizabeth Chardey Yartey in October 2000. Debrah in negotiating the purchase obtained a site plan from Elizabeth Chardey Yartey and conducted a search at the Land Title Registry. The search report confirms Elizabeth Chardey Yartey as the owner of the land and has her title registered at the Land Title Registry on 17th March 1999; her Land title certificate number is GA 14548. Debrah then made payment of GH¢13, 000 to Elizabeth Yartey for the land and took the original land certificate of Elizabeth Yartey for the purposes of preparing a deed of transfer to the plaintiff. The deed of transfer was executed and the plaintiff took possession and registered her title to the land and obtained land title certificate N0 GA 16774 from the Land Title Registry.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:2.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> The defendant contends he also purchased the same piece of land from the family of Elizabeth Chardey Yartey in November 2000. A deed dated 3rd November 2000 was executed by Elizabeth Yartey as the head of family in his favour.
