The said decision decreed ownership of the land together with buildings thereon to the plaintiff/respondent and further ordered the 1st defendant to execute an indenture in respect of the two plots of land in favour of the plaintiff/respondent. The decision also decreed recovery of possession, damages and perpetual injunction against the defendants/appellants. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The facts of this appeal are that the plaintiff/respondent who is a policeman was the husband of the 2<sup>nd</sup> defendant/appellant. The plaintiff/respondent purchased two plots of land from the 1st defendant at a cost of ¢9,000,000.00 or GH¢900.00 in the presence of the 2<sup>nd</sup> defendant/appellant for which a receipt was issued. The plaintiff/respondent put up a house on the first plot sold it out and also developed the second plot. All attempts by the plaintiff/respondent to have the 2nd defendant/appellant to issue and execute an indenture in his favour failed. Instead the 1<sup>st</sup> defendant prepared an indenture in his favour of the 2nd defendant/appellant. The plaintiff/respondent’s ex-wife, the 2<sup>nd</sup> defendant/appellant herein claimed ownership of the land containing the second plot together with the house.
