General damages for trespass to a piece of land described in his land certificate N0. GA. 5937.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Arial Unicode MS";mso-bidi-font-family:"Arial Unicode MS"">He instituted the action because the defendant resisted his development of the land and claims ownership.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Arial Unicode MS";mso-bidi-font-family:"Arial Unicode MS"">The defendant on the other hand maintains the land in dispute forms part of a tract of land his father obtained from the James Town Stool since 1959 and had been in possession ever since. His father gifted the plot in dispute to him for the purpose of operating his auto mechanic workshop. The father built on part of the larger plot and sold the adjoining plots to other people who also have built and are living on them. The area therefore is built up and the disputed land which is imbedded in the built up area belongs to him.
