A declaration that the defendant is indebted to the plaintiff bank to the tune of ¢12,823,359.00 representing the outstanding balance of a loan facility granted to defendant at his own request for which defendant has failed and/or neglected to settle despite repeated demands.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">b. An order compelling the defendant to pay to plaintiff bank cash the sum of ¢12,823,359.00 being the outstanding balance of the loan facility granted to defendant by plaintiff bank on 16/11/2000.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">c. Interest on the said sum at the current bank rate from 31/12/2001 to date of judgment”</span></i><span lang="EN-US" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif"> <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The defendant admitted owing ¢9,500,000.00 as at this 31<sup>st</sup> December 2001 and not ¢12,823,359.00 as claimed by the plaintiff. After trial the court found the defendant indebted to the defendant to the amount of ¢8,823,359.00 and ordered interest to be paid on this amount at the current bank rate from 31/12/01 to this day of judgment.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">This part of the judgment found favour with all the parties. It is therefore not a matter of concern to us. Indeed the grounds of appeal, which I will quote presently, raised no issue with this part of the judgment. It is the judgment of the trial judge on defendant’s counterclaim that the plaintiff found unsatisfactory and has appealed to this court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The case of the defendant on which he based his counterclaim, which I will quote presently, was that he had an Urvan, a commercial Bus the daily sales of which he paid into his account with the plaintiff bank. This vehicle got damaged through an accident and he took a loan from the plaintiff bank to repair it. Because he defaulted in the payment of the loan, the plaintiff bank in April 2001 got the Mankesim Police to seize the vehicle. The vehicle has since this date of seizure been with the police and is now rotten beyond economic repairs. For this seizure, which he considered wrongful, he counterclaimed for<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">“ a. An order for the payment of daily sales of the vehicle at the rate of ¢300,000 per day from April 2001 to the date the vehicle would be released to the defendant or in the alternative, a replacement of the said vehicle or the payment of its current market value”<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">That the vehicle was seized by the plaintiff as alleged by the defendant is not in dispute but the plaintiff questions the basis of the trial judge’s award which stated as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">“On the defendant’s counterclaim, the court orders the plaintiff to replace the vehicle of the defendant.
