The defendant does not dispute that an amount of GH¢50,000.00 was paid as part payment for 100 plots or 25 acres. The only dispute was that, the defendant said it was GH¢250,000 for the 25 acres.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The plaintiff, as contended by the defendant, was not able to pay the balance within ninety (90) days as agreed by the parties. The defendant’s contention therefore is that, plaintiff had breached the agreement for sale of the land. The plaintiff after some time, made the demand for his money per Exhibit “C”, dated 29<sup>th</sup> October, 2008.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The Court appointed a surveyor to assist in the identification of the boundaries. The surveyor reported, the plaintiff could not point out his boundaries because his pillars which he said he fixed had been removed. The surveyor could therefore do nothing to assist the Court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The plaintiff seems to have lost interest and credibility in the acquisition of the land. This he expressed his frustration in open Court after the surveyor presented his findings. The deposit made by the plaintiff was part payment to the 100 plots or 25 acres of land paid in December, 2007. It is true, the vendor had not even perfected any of the documents for the purchaser. The argument that, the total amount of GH¢250,000.00 should be paid within ninety (90) days, there was no proof to that assertion by the defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The plaintiff did not even ask for specific performance, at least for the value of land equivalent to the GH¢50,000.00 paid by him. The sale of the land can therefore be termed Installment Sales. This is the sale of land whereby the purchaser is required to pay the purchase price by installments. See da Rocha and Lodoh –Ghana Land Law and Conveyancing, page 189 – 1<sup>st</sup> Edition.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">It has been said by the learned authors at page 190 supra that <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;line-height: 115%"><b><i><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: Arial">“It may be unconscionable to include in installment sales contracts a condition that, as failure of the purchaser to pay an installment, the vendor shall be entitled to repossess the land and also to forfeit any payments already made.
