mso-bidi-font-family:Arial">In the accompanying statement of claim, the Plaintiff avers that the Defendant is unknown to her. She goes on to aver that in or about the year 2001 she was granted a sub-lease of a piece or a parcel of land, situate, lying and being at Abehenease near Amasaman by Madam Dora Naa Akuyea Mills of Accra who was the beneficiary of an original lease granted by Nii Odoi Kwao and Kotoku Lartey being heads and lawful representatives of the Abehenease family of Amasaman.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial">She states that she has been in undisturbed control and possession of the land after the acquisition and has exercised acts of ownership such as the laying of a foundation of a school block and developing same up to a certain level on one part of the land. However, recently the Defendant has entered the land and erected a wall and a structure on portions of the said land. She claims that the act of the Defendant constitutes trespass as she is the bona fide owner of the land by virtue of the sub-lease granted to her by the said Madam Naa Akuyea Mills. She claims the Defendant will not desist from same unless restrained by this Court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial">Since the Defendant was unknown to the Plaintiff she served him with the writ and the statement of claim through substituted service by posting copies of the processes on the Court’s notice board and on a conspicuous portion of the disputed land/property. The Court ordered that the processes should remain at those places for 14 days after which the Plaintiff applied for judgment in default of appearance which was granted and costs of GH¢1,000.00 awarded in favour of the Plaintiff on 26<sup>th</sup> April, 2010 and the case adjourned for Plaintiff to give evidence in prove of her title and damages so that final judgment could be given.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-f
