filed by Benjamin Asante Darko &amp; One Other (hereinafter called the
Petitioners) against Kencity Media Limited (hereinafter called the Respondent)
on 17th July, 2010 and the Respondent's submissions of 28th August, 2009; <o:p></o:p>Considering Section 138
and 139 of the Labour Act, 2003 (Act 651) on the functions and powers of the
National Labour Commission; <o:p></o:p>Having examined the
written submissions of the Petitioners and the Respondent and having heard the Petitioners
only, as a result of Respondent's failure to attend the Commission's hearings; <o:p></o:p>The fact of the case and
