the petition filed by Daniel Opoku Missah &amp; 10 Others (hereinafter called
the Petitioner) against Paramount Investment Ghana Limited (hereinafter called
the Respondent) on 315 August, 2010 and the Respondent's submissions of is
October, 2010; <o:p></o:p>Considering Sections 138
and 139 of the Labour Act, 2003 (Act
651) on the functions and powers of the National Labour Commission; <o:p></o:p>Having examined the
written submissions of the Petitioner and the Respondent and having heard both
parties; <o:p></o:p>The facts of the case
and pleadings may be summed up as follows: <o:p></o:p>THE CASE OF THE PETITIONER: <o:p></o:p>The Petitioners
submitted as follows that: <o:p></o:p>They were employed by
Respondent Company for Nile Dutch Africa Line. <o:p></o:p>On 15th June, 2010, management of Nile Dutch Africa Line informed them that their
employment has been terminated on grounds of redundancy without the appropriate
redundancy procedure under the law. <o:p></o:p>National Labour Commission Compensation was paid to them but management
of Nile Dutch Africa Line did not follow the due procedure of redundancy as stipulated by the law. <o:p></o:p><o:p>&nbsp;</o:p>THE CASE OF THE RESPONDNET <o:p></o:p>Respondent submitted as
follows that: <o:p></o:p>It acted as a
recruitment agency for Nile Dutch Africa Line and the Petitioners were employed
by them for that company. <o:p></o:p>The Petitioners were
employees of Nile Dutch Africa Line and were paid by the same company. <o:p></o:p>In October, 2009, the
