</div>Considering the petition filed by Daniel R.
Botwe (hereinafter called Petitioner) against K-NET (hereinafter called
Respondent) on November 2, 2007 and the Respondent's submission dated March 3,
2008; <o:p></o:p>Considering Sections 138
and 139 of the Labour Act, 2003 (Act 651) on the functions and powers of
National Labour Commission; <o:p></o:p>The Commission invited
the parties to facilitate an amicable settlement. Both parties started with the
process, however, the respondents failed to honor the Commission's invitations
on a number of occasions. The Commission therefore decided to proceed in
accordance with Section 33(2) of Regulations 2006, L.I 1822 <o:p></o:p>FACTS <o:p></o:p>The petitioner submitted
that his appointment was unfairly terminated. <o:p></o:p>The petitioner further
claimed that his Social Security contributions fall short of the amount and
payments were not up to date. He added that his leave for the period of 2001 to
2005 was not granted. <o:p></o:p>The petitioner is seeking the following reliefs; compensation
for unfair termination, payment in lieu of notice and leave to be commuted to
cash. <o:p></o:p>In reply to the petition
the respondent submitted that the petitioner flouted the rules and regulations
of the company by absenting himself from work rampantly
without any tangible reasons, reporting to work tardily
and ever ready to fight any colleague who wronged him. He was suspended for two
weeks for punching a colleague. The respondent claimed that the petitioner was verbally warned on several occasions regarding those negative attitudes but
he did not change. <o:p></o:p>The Respondent claimed
that the petitioner was summarily dismissed and therefore did not create any
legal obligation to give one month notice or pay any salary in lieu of notice <o:p></o:p>The respondent submitted
that the SSNIT contributions were in arrears for all workers due to liquidity. <o:p></o:p>The respondent finally
stated that as a matter of policy they do not buy annual leave from its
workers. <o:p></o:p>FINDINGS <o:p></o:p>
