DECISION<o:p></o:p>

</div>Facts of the complaint: <o:p></o:p>Mr. Fleape Francis and 9 others, former employees of
Tema General Hospital, lodged a complaint against their former employer, Tema
General Hospital with the National Labour Commission on 10 January, 2011. <o:p></o:p><o:p>&nbsp;</o:p>They stated that they had worked with the
Hospital for periods of 14, 13, 8, 5 and 3 years, starting from 1997 to 2010. They were issued with termination letters on 14 December, 2010, without any compensation. They were told that they
were old and should stop coming to work from 1 January, 2011. <o:p></o:p>The relief sought was, to pay them their entitlements. <o:p></o:p>Management agreed that
complainants were their former employees and most of them had worked with them
before 2003. They were casual workers. When the Labour Act 2003, Act 651, was passed those who were employed before 2003
were paid all their entitlements. <o:p></o:p>The Hospital, thereafter, re-employed them on
six (6) months contract basis. <o:p></o:p>The Hearing: <o:p></o:p>The Commission invited the parties for a
