</div>Facts of the Case: <o:p></o:p>Ms Ivy Andoh, through
her Counsel Saahpartners, lodged a complaint against her former employer, Novo
Ghana Limited, for unfair dismissal of her employment on 10 February, 2011. The
Counsel stated that Ms. Andoh was accused of non-performance which was largely
fabricated and without merit. <o:p></o:p>Employer stated that Ms Andoh: <o:p></o:p><p class="MsoNormal" style="margin-top:13.35pt;margin-right:0cm;margin-bottom:
0cm;margin-left:36.0pt;margin-bottom:.0001pt;text-align:justify;mso-pagination:

yes">1. Demonstrated acts of
gross insubordination, discourtesy, unruly behavior and lack of proper decorum
in presence of the executive management. <o:p></o:p>2. Disregarded the Business Development
Manager's appeal to render apology to the Group's Managing Director <o:p></o:p>3. Failed to provide one of the crucial documents during the
group's auditors visit to the company between 25-27 January, 2011. <o:p></o:p>The Facilitation: <o:p></o:p>The following persons

the discussions that Ms. Ivy Andoh was offered appointment as a Client Service
Executive by Novo Ghana Limited in a letter dated 30 June, 2010, on an annual gross salary of GH¢12,600.00. It was stated
in the appointment letter that: <o:p></o:p><p class="MsoNormal" style="margin-top:12.55pt;margin-right:0cm;margin-bottom:

required to comply with the company's rules, regulations and general codes of conduct as are defined in the Company
Policy Handbook, which will be given to you. These company
rules and regulations constitute part of the employee's terms of employment".
