</div>Facts of the Complaint: <o:p></o:p>Margaret Botchway, the
complainant, reported that she worked with Mendskrom Motel, Mile 7, Winneba Road, as a compound
cleaner from 1996. She was not given any appointment letter and thus her employment
was oral employment. She was dismissed by her employer in December, 2010, verbally, without any reason. She, therefore, appealed to the Commission to request the employer to pay
her compensation for wrongful dismissal and also to pay her for the month of
December, 2010. <o:p></o:p>Emplover <o:p></o:p>Employer responded that
complainant was actually employed on 5 April, 1997, and not 1996. He confirmed
that no appointment letter was given her and so the employment was oral. He
said the complainant was not a dedicated worker and was given many verbal advices
and warnings but this could not change her attitude towards work. <o:p></o:p>Employer continued that
complainant had a loan from the Motel and paid, leaving a balance of twenty
Ghana Cedis (GHC20.00). She also guaranteed her sister Ms Ama Fati, who
was also an employee, to obtain a loan of one hundred Ghana Cedis (GHC100.00). Ms. Ama Fati left the Motel leaving a
balance of her loan standing at sixty-five Ghana Cedi (GHC65.00). <o:p></o:p>Employer stated that
complainant was terminated on 30 November, 2010, but came for her pay on 30 December, 2010. She did not work
for December, 2010, and, therefore, was not entitled to any pay. Her termination was as a result of her
attitude towards work and also insulting the Managing Director, Mr. Atole
Banson Mends, on 30th November, 2010. <o:p></o:p>Employer asked employee
to pay back the balance of loan she took, which is twenty Ghana Cedis
(GHC20.00), and also the balance of the loan of her sister Ms. Ama Fati, which
she guaranteed, that is, sixty-five Ghana Cedis (GHC65.00) making a total of
eighty five Ghana Cedis (GHC85.00). <o:p></o:p><p class="MsoNormal" style="margin-top:0cm;margin-right:395.6pt;margin-bottom:
