</div>Considering the Petition filed by Michael
Dzivenu (hereafter called the Petitioner) against Ashiedu Keteke Mutual Health
Insurance scheme (hereafter called the Respondent) on January 28", 2009 and the Respondent's submissions of April 20, 2009; <o:p></o:p>Considering Section 138 and 139 of the Labour Act, 2003 (Act 651) on the functions and powers of the
National Labour Commission; <o:p></o:p>Having examined the
written submissions of the Petitioner and the Respondent and allowed the two parties to meet with
the Commission on this matter in hearings/facilitation
process. <o:p></o:p>The facts of the case
and the pleadings may be summed up as follows: <o:p></o:p>The Petitioner submits

He was appointed as the public relations manager of the scheme on

He was not granted a hearing on the allegations which was leveled

He was accused of gross misconduct, insubordination, arrogance in a
condescending manner and numerous complaints from service providers, staff and
