</div>Considering the petition filed by Stephen A.
Amponsah (hereinafter called the petitioner) against National Service
Secretariat (hereinafter called the Respondent) on 30 December, 2008 and the
Respondent's submissions of 12th June, 2009; <o:p></o:p>Considering Sections 138
and 139 of the Labour Act, 2003 (Act
651) on the functions and powers of the National Labour Commission; <o:p></o:p>Having examined the
written submissions of the Petitioner and the Respondent and having heard both
parties; <o:p></o:p>The facts of the case
and pleadings may be summed up as follows: <o:p></o:p>THE CASE OF THE PETITIONER <o:p></o:p>The petitioner submitted
as follows that: <o:p></o:p>He picked up an
appointment letter to do a voluntary service after the regular national service. <o:p></o:p>He was taken through the
formal procedure and was posted to the St. John's Grammar School in Accra. That at the St. John's Grammar school, he was told that there was no vacancy so he had to go back to
the Respondent's office where one man by the name Mr. Nashiru who issued him
the appointment letter, made the change from St. John's Grammar School to
the Islamic Education Project (IEP)
