</div>MEDIATION TERMS OF SETTLEMENT<o:p></o:p>We, the negotiating teams of the Maritime
&amp; Dockworkers' Union (MDU) and the Atlantic Port Services Ltd (APS) after
having deliberated on the dispute referred to the National Labour Commission
(NLC) in the presence of Peter Amaleboba Esq. the Mediator
appointed by the NLC. HEREBY AGREE
ON THE FOLLOWING TERMS OF SETTLEMENT. <o:p></o:p>1. RECALL OF EMPLOYEES <o:p></o:p>a) That all
employees in the employment of APS prior to the occurrence of the dispute shall
be recalled to work as soon as APS' operating license has been restored by the
GPHA. <o:p></o:p>b) That all employees shall sign individual
undertakings not to assault fellow &nbsp;Employee/s,
Director/s or Member/s of the company within a period of one
year following the execution of these Terms of Settlement. <o:p></o:p>2. PAYMENT
OF OUTSTANDING SALARIES AND OTHER REMUNERATION <o:p></o:p>a) That both sides shall use the medium of the Joint Standing
Negotiating Committee (JSNC) to negotiate and resolve all the outstanding
salary issues. <o:p></o:p>b) That all salary arrears in relation to the period worked
prior to the occurrence of the dispute shall be paid based upon the pre-IMC salary levels. <o:p></o:p>c) That both sides shall
further use the medium of the JSNC to negotiate new salary levels. <o:p></o:p>
