</div>INTRODUCTION. <o:p></o:p>The Mediator collected her letter as Sole Mediator in the case sighted above on 14th of March 2010. She immediately tried to get in touch with Maersk Ghana Ltd and UNICOF. The contacts were made the next day with MAERSK and with
UNICOF two days later. The first week was used to gather information on both
sides to bring out the real issues arising out of the complaints and the responses.
A meeting which was agreed for the 3 parties to meet on Friday 18th March, 2011 could not come on because the Maersk Representative could unavoidably not
make it. Unavailability of all three parties at different times has regrettably
contributed to the delay in presenting the report. <o:p></o:p><o:p>&nbsp;</o:p>The disputes <o:p></o:p>There were six issues to be resolved. These were discussed and resolved
as follows: <o:p></o:p>Issue 1 <o:p></o:p>The first issue raised concerned the rights
of a group of staff who worked in the Damco Department of Maersk Ghana Ltd. who
were transferred to a new company called DAMCO Logistics Ghana Ltd. Their
conditions of employment were to remain the same as when they worked for Maersk
Ghana Ltd. <o:p></o:p>The Meeting agreed to recognize that the staff had the right:
<o:p></o:p>• to
stay and work for Damco Logistics Ghana Ltd.; or <o:p></o:p>• to
walk away from the company. <o:p></o:p>
