Ltd., Berekum’) at the trial court may be summarized as follows: he was engaged by Khawaja Brothers Co. Ltd. to convey 1000 bags of sugar from Tema to Kumasi. Because none of the vehicles in his fleet was available to convey the goods, he ‘contracted the defendants’ truck with registration number GN 384 Y …to convey the sugar from Tema to Kumasi.’ The vehicle was driven by its driver with his driver’s mate in attendance. Whilst the loaded truck was on its way from Tema to Kumasi, he monitored its movement by making several phone calls to the driver. After the estimated time of the arrival in Kumasi of the vehicle and its sugar cargo had passed, he tried to reach the driver of the vehicle still by phone but to no avail. The sugar was thus never delivered to its destination in Kumasi as a result of which Khawaja Brothers Co. Ltd. had demanded the 1000 bags of sugar or its market value from him. Several weeks later, the vehicle was found parked at the residence of the 2<sup>nd</sup> defendant without the 1000 bags of sugar. The painstaking investigations of the respondent and the police revealed that the vehicle belonged to the defendants who ‘had reasonability for it’. Despite that fact, the defendants refused to identify the driver ‘or show his location’ so that he could be arrested and interrogated by the police.
