The Plaintiff claims that at various occasions until 12<sup>th</sup> February 2008, it supplied the Defendant quantities of linoleum carpets in respect of which the Defendant/Appellant is indebted to the Plaintiff in the sum of GH¢12,550.00. The Plaintiff therefore sued for the said sum together with interest at the prevailing bank lending rate till the date of final payment. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The Defendant denied the claim of the Plaintiff and in his defence alleged that the Plaintiff and its agents entered his shop in his absence and made away with carpets worth GH¢96,250.00 which was later amended to read GH¢32,060.00. The Defendant therefore counterclaimed for:<o:p></o:p></span></p><p class="MsoListParagraphCxSpFirst" style="text-align:justify;text-indent:-27.0pt; tab-stops:.5in"><b><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">“ a. Dissatisfied with the said judgment, the Defendant appealed to this Court on 31<sup>st</sup> May 2011 seeking by way of relief to have the judgment of 9<sup>th</sup> May 2001 reversed and set aside and judgment entered in favour of Defendant/Appellant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The grounds of appeal as contained in the Notice of Appeal filed by the Defendant are as follows:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">“1. That the judgment is against the weight of evidence.<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">2. That the trial judge erred when he dismissed the unchallenged evidence of DW2.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">3. That the trial erred in failing to award damages against the Plaintiff/Respondent for an infringement of the constitutional and proprietary right of the Defendant/Appellant.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">4.
