The plaintiff sued the 1<sup>st</sup> defendant as chairman of Greater Accra Car Dealers Association for himself and on behalf of the estate of his two brothers as joint owners of the land in dispute. The facts about the land in dispute are as follows: It is located at Airport area along the Spintex Road. The subject property has been described in a schedule contained in the plaintiff/respondent’s statement of claim.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">According to the plaintiff, the disputed land originally belonged to the people of Teshie until 1<sup>st</sup> September, 1944 when the Colonial Government acquired the said land through the Public Lands Ordinance, Cap 134 (1951 Rev.) under a Certificate of Title for extension of the Accra International Airport.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">It is the case of the plaintiff that in 1964 they acquired a freehold interest in the land in dispute from the then Mankralo of Teshie who was the lawful representative of the Krobo Quarter of Teshie, Nii Klu Tsuru Nmashie II. They claimed their grant was evidenced by an indenture dated 19<sup>th</sup> January, 1964 and registered as No. 1574/1977, AC 9016/75. The plaintiff contended that he had vacant possession of the land in 1964 after the grant and used to farm on the land before and after the registration of their indenture in 1977. He averred that sometime ago he learnt the Government of Ghana had made a proposal to extend the runway of the Kotoka International Airport to cover their land but the idea was later abandoned. <o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The plaintiff maintained that he was in possession as owner when 1<sup>st</sup> Defendant Association came unto the land to occupy it for the purpose of selling cars.
