The Appellant further filed additional grounds of appeal on 8<sup>th</sup> November, 2010. The grounds of appeal are as follows:<o:p></o:p></span></p><p class="MsoNormal"><span lang="EN-US" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif"> “1. <b><i>That the ruling is against the affidavit evidence<o:p></o:p></i></b></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-indent:-36.0pt"><b><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">2. That further evidence aside of the affidavit evidence ought to have been taken against the backdrop of the Respondent’s/Appellant’s denial the he had custody of the stool paraphernalia.<o:p></o:p></span></i></b></p><p class="MsoNormal" style="margin-left:72.0pt;text-indent:-36.0pt"><b><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">3. That the conviction is not maintainable and furthermore the sentence is harsh”.<o:p></o:p></span></i></b></p><p class="MsoNormal"><span lang="EN-US" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">The two grounds contained in the additional grounds of appeal are thus:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">“i<b><i>. the trial judge committed an error when he held that the lawyers for the Applicant/Respondent’s demand notice dated 21<sup>st</sup> July, 2008 was proper notice in the face of Regulations 9(3) (4) and (6) of L.I. 798 and<o:p></o:p></i></b></span></p><p class="MsoNormal" style="margin-left:36.0pt"><b><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">ii. The trial Judge misdirected himself when he relied on the Applicant /Respondent lawyer’s Demand Notice of 21<sup>st</sup> July, 2008 to convict the “Respondent /Appellant”.<o:p></o:p></span></i></b></p><p class="MsoNormal"><span lang="EN-US" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">The brief facts of the case were that the Respondent herein instituted an action against the appellant herein at the Judicial Committee of the Ajumako Traditional Council. In the course of the trial at the Judicial Committee of the Ajumako Traditional Counci
