Amanor (hereinafter referred to as "the Complainant") against the unfair treatment meted out to him by the Tema Sub-Regional Office of the Commission on Human Rights and Administrative Justice (hereinafter referred to as "the Respondent") when he lodged a complaint with it.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">THE COMPLAINANT'S CASE<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In his complaint, the Complainant alleged that one Mario Adjor was his ex-wife and that their marriage was blessed with a daughter in 1972. However due to Mario Adjor's uncooperative attitude towards him, he dissolved their marriage. Since then all his efforts at meeting and interacting with his daughter was thwarted by Mario Adjor. The Complainant further alleged that he was informed that his daughter now resided in London and had a daughter who recently was brought down to Ghana to live with Mario Adjor, her grandmother. The Complainant concluded that he sent his granddaughter some Christmas gifts which incurred the wrath of his ex-wife because she had previously warned him never to set foot in her house.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .2pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">However, in the course of investigating his case the Commission invited Mario Adjor and their daughter, who had just returned to Ghana from London, but neglected to invite him (the Complainant). Thereafter, the Respondent did not bother to inform him of what transpired at the said meeting until he visited its Office to check up on his case. The Complainant concluded that he intended instituting legal action against Mario Adjor for peddling falsehood against him and will rely on the Commission's support when the hearing of the case commences in court.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">THE RESPONDENT'S CASE<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .2pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Following the receipt of the above titled complaint on 15th January 2008, the Respondent claimed that it explained to the Complainant that it would try and talk to his ex-wife on his behalf but pointed out to him that under the circumstances, it could not compel her to meet his claims. The Respondent further claimed that it explained to the Complainant that in the event it failed in its conciliatory attempt at resolving this complaint, the Complainant had the option of pursuing legal action against Mario Adjor before the law courts.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .95pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Respondent however claimed that its investigations into the case did not proceed as if initially planned. It explained that with the knowledge of the Complainant, if threw an invitation to the Respondent on two (2) different occasions in or about February 2008 to visit its Offices for a meeting but she did not turn up. The Respondent added that on 18th April, 2008, Mario Adjor called at its Offices with her daughter, unannounced. At the meeting, Mario Adjor explained to the Commission that although she received its thought it wise to come with her daughter who was visiting Ghana from the United Kingdom soon. Mario Adjor added that unfortunately, the period of her daughter's stay in Ghana had come to an end and she was due to return to London the following day. She also intended taking her daughter along with her too.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .7pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In her submissions to the Respondent, Mario Adjor's daughter mentioned that she had not met the Complainant for the past twenty (20) years since she left Ghana for the United Kingdom. She also mentioned that she had never considered the Complainant as her father and did not want to see him or permit her daughter to meet him.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Respondent added that the Complainant thereafter visited its Offices on 30th April 2008 and was informed of what transpired at the meeting. It was at this juncture that the Complainant intimated to the Respondent his intentions of taking legal action against Mario Adjor.
