The claims are purely declaratory. I do not intend to quote these reliefs verbatim in this judgment. The facts are that Kofi Amponsah-Boateng representing the company said he purchased property H/No 12, AugustinoNeto Road. His workers were however stopped. The reason being that, the property belongs to Albert Osei. The said Albert Osei; the facts indicated, was the successful bidder to the property. The 2<sup>nd</sup> defendant, the Liquidator, argued that the property was sold to the 1<sup>st</sup> defendant as that property belonged to the defunct Ghana Airways. It is however interesting to note that, Albert Osei was a former board member of Ghana Airways.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">The defendant also tendered a lot of documents through one Trevor KwaminaHaizel to inedicate that, the property in issue belongs to Ghana Airways. It has been indicated in Exhibit “H” H/No. 10, AugustinoNeto Road belonged to Ghana Airways. However, H/No 12, AugustinoNeto Road does not include the landed properties listed in Exhibit “H”. The said Exhibit “H” listed properties situate at Kisseman and Sakamono Ridge and North Labone, Dansoman, Castle Road, Takoradi, London and Sierra Leone etc.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">The PW1, the contractor hired by the plaintiff to do the work testified on the 7<sup>th</sup> day of July 2009 as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:1.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-1.5in; line-height:115%"><b><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">WITNESS: One day I was out of the site and I had a call from my juniors that a man was there called Albert Osei says that I should see him. So his number was given to me by my foreman… he said I should meet him at the Emmanuel Eye Clinic. He told me the house was offered to himby Ghana Airways, so I asked him that are you sure of what you are saying… So he went into his car and brought an offer letter, immediately I saw the offer letter I said my friend you are talking about a different house. Because the offer letter carries the heading, Offer of House No. 10, AugustinoNeto Road.
