Where it rested on disputed facts, then the point of law must abide the full trial unless the disputed facts could be disposed of with the least difficulty.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">It is material to recount in the instant case that the 1<sup>st</sup> defendant in paragraphs 2 and 3 of his Statement of Defence filed on 28/07/10 had denied the assertion of the Plaintiff contained in paragraph 1 of his Statement of Claim accompanying his Writ that he is the head of the Okromansah Amoah family of Amrahia.
