The Respondent filed an answer on the 25th January, 2011 and cross-petitioned for a dissolution of the marriage and any other order(s) or reliefs the court might deem fit to make. Both of the parties acted by counsel. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">When the Petitioner led evidence on the 8th December, 201, the petition was adjourned to the 12th January, 2012 for him to be cross-examined by the Respondent but counsel for the Respondent on that date declined to cross-examine the Petitioner and rather prayed for the dissolution of the marriage. Counsel expressly discontinued the claim for an ancillary relief. The uncontested and unchallenged evidence of the Petitioner was led by his Lawful Attorney, Bonaventure Bonney Amaachaab of Ashaiman, Accra. He tendered the Power of Attorney as EXHIBIT 'A'. His evidence was that the Petitioner and the Respondent got married under the Marriage Act 1884-1995 (Act 127) at the Tema Municipal Assembly on the 5th August, 2004. They co-habited in Tema and thence in the United States of America (USA). He said the Respondent has become quarrelsome and hostile to the Petitioner. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">She has decided not to have any child with the Petitioner and has on occasions threatened to stab the Petitioner for attempting to have sex with her. She has expressly stated that she wished the Petitioner dead. She sometimes left the matrimonial home for days without disclosing her whereabouts. The families of the parties and their church elders have all tried to reconcile them to no avail. The Petitioner and the Respondent could not continue to live under one roof as husband and wife or at all. Without cross-examining the Petitioner upon his said evidence the Respondent is deemed to admit same and no further proof was required in the circumstances. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">See TAKORADI FLOUR MILLS v. SAMIR FARIS (2005-2006) SC GLR 882 @ 890 I find from the evidence a strong case for the breakdown of the marriage beyond reconciliation and I so hold. I grant the prayer of the parties for the dissolution of their said marriage for that matter. <o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">I declare and decree that the marriage contracted and solemnized between the parties herein at the Tema Municipal Assembly Office of the Registrar of Marriages under the Marriage Act 1884-1995(ACT 127) be and is hereby dissolved for having broken down beyond reconciliation. Each party shall bear his or her own costs of the proceedings.<o:p></o:p></span></p></span>
