The application was filed by the 2<sup>nd</sup> defendant/appellant/applicant, to be referred to simply as the 2<sup>nd</sup> defendant for an order to stay the judgment to enable it pursue an appeal against it at the Court of Appeal. The judgment under attack was entered in favour of the plaintiff/respondent, to be called the plaintiff, in respect of a parcel of land known as property No. 1 Block ‘A’ Adum Light Industrial Layout, Kumasi. The property was bought by the plaintiff through the co-defendant who acted as his counsel, but was resold to the 2<sup>nd</sup> defendant by the co-defendant, under circumstances, the plaintiff claimed he was unaware of, and did not give his consent to the sale. He therefore instituted action against the 2<sup>nd</sup> defendant, the 1<sup>st</sup> defendant who was the original leasehold owner of the property, and the Lands Commission to prevent it from registering it in the name of 2<sup>nd</sup> defendant, whilst the co-defendant was joined to the action at the instance of 2<sup>nd</sup> defendant.
