</div>MEDIATION REPORT<o:p></o:p>THE BACKGROUND <o:p></o:p>The
sole mediator was appointed to mediate in the petition lodged by the
Complainant with the National Labour Commission against the Respondent for
unfair termination of his appointment in May, 2012 <o:p></o:p>ISSUE: <o:p></o:p>Fair or unfair
termination of appointment of the Complainant. <o:p></o:p>PROCEEDINGS <o:p></o:p>Mr. Maxwell Mill's, the Complainant who was
at the mediation was led by Mr. Senyo M. Adjabeng his consultant while the
Respondent Company was represented by her lawyer, Mrs. Amerlay Bortei-Doku &amp; Mr. Kwesi Austin of Amerteifio &amp; Co. It was established
that both representatives had the mandate to determine the matter. <o:p></o:p><o:p>&nbsp;</o:p>SESSIONS <o:p></o:p>The mediator had three
meetings with the parties. These meetings included one pre- mediation meeting.
He also had separate meetings (caucus) with the parties to ensure better
understanding of issues towards resolution of the dispute. The National Labour Law, Act 651 and the Legislative Instruments 1822 and 1833 were used as
guiding enactments for the discussions. <o:p></o:p>During the meetings the
Mediator explained to the parties the need to be committed to the mediation
process for early resolution of the matter since protracting the mediation
process has the effect of adding to time spent and costs. <o:p></o:p>COMPLAINANT'S SUBMISSION <o:p></o:p>The Complainant said he
was employed in 2005 as a Logistics Manager but his job was reshuffled due to a
restructuring exercise that was undertaken by the respondent company in 2008.
He was assigned the position of Regional Supply Chain Manager which was higher
than the formal position with different responsibilities. According to the Complainant, he had two problems which were affecting his performance
in trying to cope with his new position which he discussed with the Respondent
