This is an appeal from the judgment of the High Court Sunyani dated 2<sup>nd</sup> March 2011. The Plaintiff/Respondent (hereinafter referred to as Respondent) commenced action against the Defendant/Appellant (hereinafter referred to as Appellant) seeking the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:1.5in;text-align:justify;text-indent: -1.0in;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">“(a). Recovery of cash the sum of ¢107,500.00 or GH¢10,750.00 being the Plaintiff’s share of interest free financial assistance granted them.<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial"><o:p> </o:p></span></i></p><p class="MsoNormal" style="margin-left:1.5in;text-align:justify;text-indent: -1.0in;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">(b). The facts giving rise to this suit are that; both Appellant and Respondent herein were employees of a company called Bet Exports Company Ltd. According to the Respondent’s pleadings, in or about October 2005, the Managing Director of Bet Exports Co. Ltd. agreed with the parties to grant them an interest free financial assistance of ¢215,000.000.00 for their private businesses whereupon they agreed and jointly bought sugar for sale, the proceeds of which was used to purchase rice also for sale. The Respondent claims he is entitled to the sum equivalent to 50% of the said interest free financial assistance. The Respondent’s case is that the goods were to be purchased and sold out in a revolving manner subject to the Appellant paying to Respondent the sum of ¢4,000.00 every month as profit from the Respondent’s share of capital. The Respondent took an action in the High Court against the Appellant because the Appellant had refused to pay the Respondent’s share of the capital upon demand as well as the profits accruing from the application of the funds.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">3. The Appellant denied the claim asserting that contrary to the Respondent’s allegation contained in paragraph 3 of the Statement of Claim he had been in the position of purchasing clerk with Bet Exports Company Ltd. and held that office from 2001 – 2003 when he was promoted to the position of Assistant Director in 2004 in recognition of his hard work and had held that position up until the commencement of the action. In specific denial of the Respondent’s allegation that the sum of ¢215.000.000.00 was intended to be shared between Appellant and Respondent which the Appellant is alleged to have refused to account for and/or give the Respondent his share thereof, the Appellant asserts that he was entitled to commission of ¢100.00 per kilogram of cashew purchased by Bet Exports Company Ltd. and that between 2004 and 2007 a total of 13,500 metric tons was purchased by the Bet Exports Company Ltd. for which he (Appellant) was entitled to the sum of ¢100.00 per each kilogram.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">4. The Appellant asserts that sometime in 2005, he approached Tom Kwarteng Amaning the Managing Director of Bet Exports Company Ltd. an uncle of the Respondent and demanded for payment of part of his commission. The Appellant asserts that it is in consequence of the demand that the Managing Director of the company purchased 1000 bags of sugar at the price of ¢21,500.00 per bag representing part payment of the Appellant’s accumulated commission. The Appellant alleges that the Respondent’s claim to a share of the cost price of the sugar was an afterthought and a calculated mischief by the Respondent and the said Tom Kwarteng Amaning to deprive him of the outstanding commissions owing and due to him by Bet Exports Company Ltd.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">5.
