font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> </span></span><!--[endif]--><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Damages.”<o:p></o:p></span></p><p class="MsoNormalCxSpFirst" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The case of the Plaintiff is that it acquired two plots of land which is the subject matter in dispute from the late Chief of Essuowin, Nana Akyina Kesse IV in 1997 at the cost of </span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">¢</span><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">12million. According to the Plaintiff Nana Akyina Kesse IV issue the Plaintiff an allocation note and site plan in respect of the two plots. The Plaintiff alleged that after the acquisition of the plots, it went into occupation of same and started to build a school on one of the plots number 8A. Upon the death of Nana Akyina Kesse IV, the Defendant who claims to be the Kyidomhene and regent of Essuowin stool resisted the Plaintiffs claim and attempted to take the two plots from the Plaintiff. The matter finally ended at the Asantehene’s Secretariat where the matter was resolved by one Akyina and Others. After the resolution, the Plaintiff started to wall the plots but the Defendant caused the arrest of the agents and workmen of the Plaintiff by the Police who later released them. Subsequently the Defendant caused the Manhyia Police to arrest them whereby the Bantamanhene arbitrarily distributed the plots into two for the parties. Hence the action. <o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant on the other hand resisted the claims of the Plaintiff and insisted that the plots had never been alienated by the Stool to the Plaintiff. According to the Defendant at the time that Nana Akyina Kesse IV was alleged to have executed the Plaintiff’s allocation note, he was bedridden and could not have executed same. The Defendant averred that the Plaintiff at a point in time asserted that the allocation note was thumb printed by the Odikro of Santasi, Nana Osei Akoto, which assertion the Odikro vehemently denied. When a specimen thumb print of Nana Osei Akoto and that on the Allocation Note relied on by the Plaintiff was taken to the Police forensic laboratory, the thumbprint on the Allocation Note was found to have been forged. Upon the installation of Nana Akyina Kwagyan Nnuame V as the new Essuowinhere, the Plaintiff led by one Nana Poku presented customary drink to him in accordance with custom but when he found out that the Plaintiff was unlawfully occupying the disputed plots he asked the Plaintiff to vacate. The Plaintiff pleaded to the new Chief to be given the two plots and subsequently petitioned the Asantehene’s Land Secretariat. The Secretariat having discovered that the Plaintiff
