The summary of facts giving rise to this appeal are as follows: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">By writ issued from the registry of the Circuit Court Kumasi the Plaintiff/Respondent (hereinafter referred to as Respondent) claimed against the Defendants including the 4<sup>th</sup> Appellant herein the following:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;text-indent: -.5in;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">“(a). Declaration of title to all that piece and parcel of land situate and lying at Plot No. 6 Block 13 Nkwaano, Atwima.<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial"> (b). The 4<sup>th</sup> Defendant (Appellant herein) not only contested Respondent’s claims but counterclaimed for the following reliefs<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;text-indent: -.5in;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">“(a). A declaration that the title in the said Plot No. 6 Block C, Tabere Nkronda is vested in the 4<sup>th</sup> Defendant <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial"> (b). Any further or other orders or reliefs as shall be just in the circumstances of this case and the inherent jurisdiction of the court and in terms of order 63 rule 6 of the High Court (Civil Procedure) Rules and especially an order of perpetual injunction restraining the Plaintiff, his servants agents, workmen, or any other persons legally claiming through him from interfering with the 4<sup>th</sup> Defendant’s title to or possession of his said plot or from otherwise dealing with it in any other way adverse to the 4<sup>th</sup> Defendant’s title or possession thereof”. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-MY" style="font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">3. The trial Circuit Court Judge found for the Plaintiff (Respondent herein) and held the Plaintiff as the owner of all that piece or parcel of land situate and lying at Akwanoa Atwima and known as Plot 6 Block 13. He further granted an order for recovery of possession and general damages of GH¢4,000.00 for trespass by the 4<sup>th</sup> Defendant into the disputed plot as well as perpetual injunction restraining the Defendants, their agents, assigns from interfering with Plaintiff’s interest in the disputed plot and costs of GH¢1,000.00
