This is an appeal from the judgment of the High Court, Kumasi dated the 18<sup>th</sup> January, 2010.<o:p></o:p></span></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">2. The facts of this case are that; by a Writ of Summons issued from the High Court, Kumasi on 28<sup>th</sup> February, 2003, the Plaintiff/Respondent (hereinafter referred to as the Respondent) commenced an action against the Defendant/Appellant (hereinafter referred to as the Appellant) for the following reliefs.<o:p></o:p></span></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma"> 1. Declaration of title for (sic) a 2.27 Acre of land on PLT 14 BLK “A” on Boadi Stool Land, Kumasi is the property of Nana Araba Essibu. <o:p></o:p></span></i></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma"> 2. The Appellant filed his statement of Defence to the Respondent’s plaint and contended that the Respondent was not entitled to her claims.<o:p></o:p></span></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">4. It is pertinent to distinctly set out the respective cases of each of the parties as disclosed by their pleadings and the evidence adduced by them during the trial.<i> </i>The case of the Respondent as disclosed by her pleadings is that she acquired a 2.27 acre land at Boadi a suburb of Kumasi in 1997 for an educational complex. She averred that she was a party to a Deed of Assignment which had the Appellant as the other party and that by reason of that, the land aforesaid was transferred to her.<o:p></o:p></span></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">5. The Respondent further asserted in her pleadings that the Appellant was resident on the said land and that title to same which was hitherto vested in the Appellant was transferred to her by virtue of the said Deed of Assignment. According to the Respondent the said Deed of Assignment was dated 2<sup>nd</sup> May, 1997 and was witnessed by four credible witnesses.<o:p></o:p></span></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">6. From the Respondent’s pleadings, there is a proviso in the said Deed of Assignment which stipulated that the Assignor’s old existing house on the land was also leased to the Assignee and that he would vacate the land and the building thereon. The Respondent averred that it was agreed between her and the Appellant that she would build an identical house on one – six (</span><span style="font-size:12.0pt;line-height:115%;font-family:"Cambria Math","serif"; mso-bidi-font-family:"Cambria Math"">⅙</span><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">) portion of the said plot of land for the Appellant.<o:p></o:p></span></p><p class="MsoListParagraphCxSpMiddle" style="margin-bottom:0in;margin-bottom: .0001pt;mso-add-space:auto;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">7.
