This appeal is from the judgment of the Circuit Court Kumasi, dated the 5<sup>th</sup> day of June 2007. The facts of the case giving rise to this appeal are that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">2. By writ of summons issued from the registry of the Circuit Court Kumasi the Plaintiff/Respondent (hereinafter referred to as “the Respondent”) instituted action against the Defendant/Appellant (hereinafter referred to as “the Appellant”) for:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:1.0in;margin-bottom:.0001pt;text-align:justify;text-indent:-1.0in"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma"> “An order of specific performance of the contract of sale of Defendant’s Kejetia storeroom No. ADS 118, whose full purchase price of ¢170,000.00 (One Hundred and Seventy Million Cedis) the Plaintiff has paid to Defendant but Defendant has failed, neglected and or refused to give possession thereof to Plaintiff and is occupying same”. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">3. The case of the Respondent a trader, is that early in 2004 the Appellant indicated he was selling his (Appellant’s) store No. ADS 118 at a purchase price the Appellant initially fixed at ¢100,000,000 (One Hundred Million Cedis) but which was eventually raised to ¢170,000,000 (One Hundred and Seventy Million Cedis).<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">4. The Respondent asserted that he made full payment of the purchase price of the store to the Appellant, albeit in installments. He was emphatic that payments to the Appellant were made in the said store in dispute. The Respondent testified that when he made a total payment of ¢110,000,000 the Appellant issued him with a receipt which was tendered in evidence without objection and same was admitted and marked Exhibit ‘A’. The full contents of Exhibit ‘A’ states:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:1.0in;margin-bottom:.0001pt;text-align:justify;text-indent:-1.0in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma"> <i>“This is to certify that, I Kwadwo Barima of Post Office Box KJ 133 Kumasi have received cash the sum of One Hundred and Ten Million Cedis (¢110,000,000) from Kwabena Ayele of Post Office Box 6802 Kumasi being part payment of the purchase price of my stall at Kejetia Kumasi leaving an outstanding balance of (¢60,000”,000.00) to be paid by Kwabena Ayele on or before 14<sup>th</sup> day of February 2005. That the necessary papers would be made in favour of the said Kwabena Ayele after final payment”<o:p></o:p></i></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Tahoma">5. The Respondent’s case is that although he had paid for the store about two years earlier, the Appellant and his wife continued to occupy the store and had failed to yield vacant possession of same to him.
