The judgment so delivered went against plaintiff who being dissatisfied filed this appeal.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">For one to appreciate the nature of this case it is relevant to look at the facts. It is agreed by the parties that the plaintiff took a lease from the 1<sup>st</sup> defendant for a number of years. By the lease agreement, plaintiff was allowed to pull down the old and weak structures and construct one building which was to be used as shops.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">After the construction the lessor allowed 2<sup>nd</sup> defendant to put up a set of rooms on top of the building put up by the plaintiff and thus converting it into a storey building against the wish of the plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The plaintiff reported the matter to the police and eventually took action in court seeking the reliefs endorsed on the writ.
