The Plaintiffs and Counsel were absent and I adjourned the suit to the 18-1-2012. All parties and Counsel were absent on that date and the suit was further adjourned today the 6-2-2012 for hearing. The Defendant has caused hearing notice to be served on Counsel for Plaintiffs and there is proof of service on the said Jonathan Sabblah on the 20-1-2012. The Plaintiffs and their Counsel are still absent without any cause shown. The claim of the Plaintiffs is accordingly dismissed under Order 36 rule 1 [2] [b] of CI 47/04. The counterclaim of the Defendant filed on the 15-9-2010 is hereby set down for trial. The Defendant shall hereby serve another hearing notice on the Plaintiffs to appear for the hearing on the counterclaim on the 16th and 19th March, 2012 at 10.00 a.m. each day. The Plaintiffs shall pay costs of GH¢500.00 to the Defendant”. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Dissatisfied with the decision of the High Court, the plaintiffs appealed to this court on the following grounds;<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">a. The trial Judge erred in dismissing the plaintiffs’ case whilst a petition to the Chief Justice to transfer the case to another judge was pending.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">b. Additional grounds of appeal shall be filed on receipt of the record of proceedings.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Before dealing with the arguments canvassed in support and against this appeal, I will give a brief background to this case.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The plaintiffs/appellants in this case issued a writ of summons claiming the following reliefs;<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">1. An order setting aside the order for demolition or possession on grounds of fraud, breach of natural justice and irregularity.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">2. General Damages.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">3. The cost of the building of 3rd Plaintiff demolished by Defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The plaintiffs’ writ was accompanied by a 12 paragraph statement of claim in which they aver that, they are owners in possession of land situate at Otinshie. The plaintiffs aver further that they are putting up building on their said land whilst the 3rd plaintiff has also put up a building on her portion but same has been demolished by the defendant. It is the case of the 1st and 2nd plaintiffs that, the defendant has threatened to demolish their development on the land. They continued that, the defendant undertook the demolishing exercise by virtue of a court order in Suit, No. IRL/403/09 titled DR. SAMUEL OHENE VS. FAUSTINA PANNIE.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is the case of the plaintiffs that as occupants of the land, they were not notified of the suit supra before the demolition exercise. They therefore contend that the order for demolition was procured by fraud and particularized the fraud as follows;<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">1. The Defendant misrepresented to the court and he sued FAUSTINA PANNIE as the one on the land.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">2. The order was obtained without notice to the plaintiffs on the land who have been in possession and are developing same.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The plaintiffs concluded that, the order of demolition was obtained in breach of the rules of natural justice and therefore void. The 1st and 2nd plaintiffs say the threat to demolish their building on the land has caused and continues to cause them fear and panic hence this action.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On receipt of plaintiffs’ writ of summons and statement of claim, the defendant reacted by filing his statement of defence denying plaintiffs’ claim.
