DORDZIE <o:p></o:p></span></b></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><b><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">FACTS <o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Until his death on the 3rd of June 2003 Sebastian Clement Dogbey also known as Osofo Kofi Ameve was the managing director of Seba Construction Ltd the respondent in this appeal. He was also the leader or Head pastor of the appellant, the Afrikania Mission Church. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Both parties occupied the subject matter of this suit, a four storey office building situate at Sakaman Junction South Odorkor. During the life time of Osofo Kofi Ameve, Seba Construction Limited had its offices, warehouse and other facilities in the building and the Afrikania Mission used part of the building to hold church services and to house trainee pastors. At the death of Osofo Ameve the respondent’s new managing director, Mrs Dogbey the widow of the deceased and other family members of the deceased took steps to eject the Afrikania Mission from the premises claiming the premises belongs to the respondent company, Osofo Ameve only permitted the appellant to use the place. The appellant resisted this claim and maintained the mission owns the property. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">This resulted in the suit instituted by the respondent in the High Court, Accra in which it claimed the following reliefs: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">1) An order for perpetual injunction restraining the defendant, its agents, servants and assigns from running its secretariat from and holding its church services at the premises. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">2) A declaration that the plaintiff is the owner of the premises at South Odorkor, Accra. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">3) Recovery of possession of the premises. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">4) General and special damages for trespass. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The defendant/appellant denied the above claims in their statement of defence and counterclaimed as follows: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(a) A declaration that the defendant is the owner of its mission headquarters at Sakaman Junction, South Odorkor, Accra <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(b) Perpetual injunction to restrain the plaintiff, its agents, servants and assigns from interfering with quiet enjoyment of the defendant’s ownership of its mission headquarters at Sakaman Junction, South Odorkor, Accra <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(c) Damages for trespass and destruction of defendant’s shrine. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The High Court gave judgment in favour of the respondent and granted all the reliefs endorsed on the writ as stated above except the 4th. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The appellant dis
