SOWAH JA <o:p></o:p></span></b></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><b><u><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">BACKGROUND FACTS <o:p></o:p></span></u></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">This is an appeal against the Ruling of the High Court, Koforidua, dismissing the applicants/appellants motion for attachment of the respondents for contempt. The Ruling was delivered on 7th February 2006. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In this appeal, the applicant/appellants will be referred to simply as the appellants, and the respondents/ respondents as the respondents. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The facts of the case as gleaned from the record of appeal are that a dispute between the Asenie and Aduana families of Ntronang in the Akim Kotoku Traditional Area as to which of the two families had the right to put someone on the stool as Odikro of Ntronang was adjudicated upon by the Judicial Committee of the Akim Kotoku Traditional Council. [Hereinafter referred to as the Traditional Council] <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The parties in that Suit were Opanin Yaw Krah and another (since deceased and substituted by the two appellants herein) as plaintiffs representing the Asenie family, and Baffour Yamoah Ponkoh [the 1st Respondent herein] as defendant. On 20th September 1979, the Traditional Council adjudged the Asenie family as the rightful owners of the said stool and ordered the 1st Respondent to hand over all the stool regalia and stool property to the plaintiffs’ Asenie family. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">However, the Respondent had refused to take part in the hearing before the Traditional Council, and upon becoming aware of the judgment, obtained an order of certiorari from the High Court Koforidua on 5th November 1980 to quash it. Thereupon the appellants also appealed the High Court Ruling to the Court of Appeal. The Court of Appeal in its unreported judgment - Civil Appeal No. 15/81 dated 14th December 1989 and titled The Republic vs. The Judicial Committee of Akim Kotoku Traditional Council; Ex-Parte Baffour Yamoah Ponkor, Odikro of Ntronang to be found at pages 165 to 175 of the Record held the trial judge to have been in error and allowed the appeal.
