The case passed through the bench of several judges and the chambers of several lawyers on both sides.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">Although there are five defendants sued, that is not the reason for the delay. This is because of out of the five defendants, only the 2<sup>nd</sup> defendant entered an appearance, filed a defence and a counter-claim and actually defended the claim of the plaintiff. But in the second year of the pendency of the suit, 2<sup>nd</sup> defendant died. She was substituted by her daughter Justice Georgina Kusi-Appouh. Unfortunately she also passed away before time could be found for actual hearing to start. Mr. Kwadwo Frimpong has since survived as the substituted 2<sup>nd</sup> defendant in the case.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">It is also observed that the facts of the case are not in any way complicated. No doubt at the trial plaintiff and his wife gave evidence in proof of plaintiff’s case, while two witnesses gave evidence for the substituted 2<sup>nd</sup> defendant. On the record therefore the actual evidence adduced is in no way commensurate with the long delay in disposing of the suit.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">The plaintiff’s case is as follows:<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">The 1<sup>st</sup> defendant sold the house on plot No. 4 Oduro, Kumasi to the plaintiff. The purchase-price of one million cedis (GH¢100.00) was paid in instalments. On 30/04/1985, 1<sup>st</sup> defendant issued the receipt for full payment to the plaintiff. The witnesses to the payment signed the receipt for both parties. Thereafter, 1<sup>st</sup> defendant executed an assignment in favour of the plaintiff and who immediately went into possession of the house.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormalCxSpLast" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">Through his lawyer, plaintiff applied for consent to the Lands Department. He paid the statutory consent fee as usual. While waiting for the consent, plaintiff alleged that the 1<sup>st</sup> defendant purported to assign the very house to the 2<sup>nd</sup> defendant.
