Thereafter, on 28<sup>th</sup> July 2009, the Plaintiff/Respondent caused a writ of <i>fieri facias (fi fa)</i> to be issued and in pursuance thereof the 2<sup>nd</sup> Defendant’s property No. 18C Anaji/Effia Residential Area, renumbered H/No.20 PT 186 used as security for the loan contracted by the 1<sup>st</sup> Defendant, was attached in execution of the judgment debt. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Officers of the High Court, Sekondi, sold the property in question under the writ of <i>fi fa </i>on the 3<sup>rd</sup> February, 2012. The 2<sup>nd</sup> Defendant brought an application to set aside the said judicial sale of the property in question on the ground that the sale was a nullity. The High Court, Sekondi in its ruling of 7<sup>th</sup> March 2012 dismissed the application. It is against this ruling that the 2<sup>nd</sup> Defendant (hereinafter referred to as the “Appellant”) has appealed to this Court. The grounds of appeal as contained in the Notices of Appeal are as follows:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"><o:p> </o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> “i. The Judicial Sale of the 2<sup>nd</sup> Defendant/Judgment Debtor’s <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify"><i><span lang="EN-US" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">property was a nullity as there was no writ of fieri facias legally or validly subsisting as at the material time of the sale.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -31.5pt"><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">ii.
