The plaintiff/appellant hereafter called plaintiff being dissatisfied with the judgment appealed against same to this court to reverse the judgment. The defendant/respondent would also be referred to in this appeal as the defendant.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:18.0pt;text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The brief facts of the case which culminated in this appeal were that the plaintiff took out a writ of summons against the defendant claiming for a declaration of title at North Taifa, recovery of possession, damages for trespass. The plaintiff took the defendant’s grantor to the police station in respect of the disputed land. At the police station, they were asked to submit their respective site plans to the Lands Commission and the results proved that they were on the same land and the land was registered in the name of the defendant’s grantors. The plaintiff, however, insisted that his land was different from that of the defendant. The plaintiff dissatisfied with the decision by the police took out a writ claiming inter alia, declaration of title and a declaration that his land is different from that of the plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:18.0pt;text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The High Court Judge on 2<sup>nd</sup> June, 2011 dismissed the plaintiff’s claims as unproved and further held that the land the plaintiff is claiming is the same land the defendant acquired from her grantor. The grounds of appeal filed by the plaintiff are as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:18.0pt; margin-left:72.0pt;text-align:justify;text-indent:-36.0pt"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">“a. <b><i>The Learned High Court Judge erred by not holding that, the plaintiff land is different and independent of defendant’s land in the face of the court ordered composite plan Exhibit ‘CE 1’ by the Regional Surveyor.<o:p></o:p></i></b></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:18.0pt; margin-left:72.0pt;text-align:justify;text-indent:-36.0pt"><b><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">b. The learned Judge further erred in not holding that plaintiff’s land is different and independent of defendant’s land when Exhibit ‘d’ which is a search from the Lands Commission tendered in evidence disclosed only plaintiff’s transaction and not Defendant’s transaction as plotted in the Lands commission records with regard to the dispute land.<o:p></o:p></span></i></b></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:18.0pt; margin-left:72.0pt;text-align:justify;text-indent:-36.0pt"><b><i><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">c. The learned Judge erred by not following the decision in Tackey vs Lamptey [2001-2002]SCGLR 1879(CA) in not holding that the land in dispute belongs to plaintiff in the face of the composite plan, Exhibit ‘CE 1’ which authority was brought to her notice in plaintiff’s address filed in the suit. &
