The Applicant alleged that the Respondent flouted the terms of a consent Judgment given by this court on 22/06/2011. The genesis of this case is that one Nana Nsiah (a contractor) agreed to put up the disputed stores which are now vested in Samuel Yaw Adih on a build, operate and transfer basis. After a series of litigations, the parties signed terms of settlement which the court adopted as consent judgment.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The said consent judgment was exhibited to the instant application as exhibits B and B1. Prior to the locking up, the Applicant deposed that the Respondent had caused notices of ejectment to be served on the tenants in spite of the Consent Judgment. She further deposed that an earlier contempt Application brought against the Respondent by another tenant was withdrawn, upon pleas from the Respondent. Photographs depicting the said locked –up stores were exhibited as SSG 4 to the application.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">In his affidavit in opposition filed on 6/11/2012, the Respondent denied any knowledge of the locking up of the Applicant’s store. He contended that he does not own the said store and has no right to lock it up. Thus, the instant application has been brought to embarrass him.
