They have been in the employment of the Defendant for a considerable period of time, ranging between five (5) years and thirty-two (32) years. At various times in 2009, the Plaintiffs were invited in different groups to appear before the Revenue Committee of the Defendant to assist it to investigate an allegation of misappropriation of funds collected by them. The Plaintiffs duly appeared before the Revenue Committee wherefore various sums of money they were alleged to have embezzled were written on pieces of paper and handed over to them. Meanwhile, when the Plaintiffs allegedly confronted the said committee on the allegation of embezzlement, it could not offer any explanation as to the date and how the Plaintiffs embezzled the sums stated against their names. It could also not explain to the Plaintiffs the circumstances on which it based to arrive at those sums of money. It rather suspended Plaintiffs and has refused to pay them their salaries since October, 2009 except 11th to 17th Plaintiffs who receive their salaries through the Accountant General’s Department. The Plaintiff, therefore, brought the current action against the Defendant by filing writ of summons together with a statement of claim on 10th February, 2010 for the following reliefs:

<span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Tahoma; mso-bidi-font-family:Tahoma">

<span style="font-family: "Book Antiqua", serif;">(a)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-family: "Book Antiqua", serif;">An order compelling the Defendant to pay the Plaintiffs their salaries which have been withheld since October, 2009.

<span style="font-family: "Book Antiqua", serif;">(b)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-family: "Book Antiqua", serif;">An order compelling the Defendant to lift the indefinite suspension placed on the Plaintiffs since the suspension is without any legal basis.

<span style="font-family: "Book Antiqua", serif;">(c)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-family: "Book Antiqua", serif;">An order compelling the Defendant to pay the Plaintiffs their salary arrears for the periods ranging from 6 to 18 months as the case may be.

<span style="font-family: "Book Antiqua", serif;">(d)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-family: "Book Antiqua", serif;">The Defendant, be ordered to redeploy the Plaintiffs to other Units/Departments of the Defendant.

<span style="font-family: "Book Antiqua", serif;">(e)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-family: "Book Antiqua", serif;">In the alternative the Defendants should declare all the Plaintiffs redundant in its hospital and pay them all the salaries, salaries in arrears and severance package in accordance with law except the 11th to 17th Plaintiffs who may be referred to the Ghana Health Service and the Controller and Accountant General’s Department as the case may be for reposting.
<p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.25in; line-height:115%;mso-list:l3 level1 lfo7;border:none;mso-padding-alt:31.0pt 31
