In December, 2008, the Defendant informed the Plaintiff that it had decided to embark on a down-sizing exercise due to the suspension of a contract between the Defendant Company and the Golden Star Resources Company Limited, a mining company. The Plaintiff was as a result asked to choose between being temporarily laid-off or permanently leave the Defendant Company with a package of one month’s basic salary multiplied by the number of years worked. The Plaintiff opted to leave permanently. It, however, realized that his benefit was subject to negotiations so he requested to be paid three months’ basic salary multiplied by the number of years worked as pertained in other similar organizations in the locality.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">The Plaintiff claims that in spite of his disagreement of one month’s salary multiplied by the number of years worked he told the Defendant Company through the Managing Director in the presence of the Human Resource Manager that if they would pay him promptly the amount they would want to pay, then he would accept it and they agreed to that request and he was assured by the Defendant through its Human Resource Manager that, it would pay him the benefit in due course.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">According to the Plaintiff upon waiting fruitlessly for months on end, he caused his lawyers to write to the Defendant on two occasions demanding payment of the benefit from the Defendant but to no avail. He as a result petitioned the National Labour Commission but that also turned out to be fruitless and upon discovering that the docket on the matter had even gone missing at the National labour Commission, he decided to take action in court for justice.
