On 25<sup>th</sup> April, 2012, the Plaintiffs filed an application for directions and the Defendant also filed additional issues on 10<sup>th</sup> May, 2012. Pursuant to an order of this court the Plaintiffs filed an amended writ of summons reducing the number of Plaintiffs from 47 to 46. Pursuant to another order of this court the Defendant filed an amended statement of defence on 18<sup>th</sup> July, 2012. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">On 22<sup>nd</sup> October, 2012 this court set down all the issues raised in the application for directions and the additional issues for determination. Since the Defendant had raised issue of limitation in its amended statement of defence, this court ordered the parties to address it on the issue of limitation which the parties complied with by filing their written submissions. Case was adjourned for ruling on the issue of limitation. However, in the course of writing the ruling it became clear that the whole action could be resolved by legal arguments.
