According to the plaintiff, after 1<sup>st</sup> defendant divested himself of his entire right and interest in the property he erected a fence wall around it. He asserted that he took possession of the property, and instructed lawyer Arnold Prempeh to prepare the relevant documentation, but it could not be completed because 1<sup>st</sup> defendant refused to sign same with a view to deprive him the benefit of a completed documentation in respect of the property.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:0cm;line-height:115%"><span lang="EN-US" style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family: Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:0cm;line-height:115%"><span lang="EN-US" style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family: Arial">It is also the case of the plaintiff that to his surprise, he discovered in 2007 that, the 1<sup>st</sup> defendant purported to alienate the property to the 2<sup>nd</sup> defendant with full knowledge he had no title so to convey. In his assertion, this is an appropriate case for the nemo dat quod non habet principle to be applied by this court. He also averred that based on the illegal transaction between the defendants, the 2<sup>nd</sup> defendant trespassed upon the property and allegedly destroyed development he put on it. Finally, the plaintiff prayed the court to regard as fraudulent, ineffectual and therefore null and void any document prepared by the defendants in respect of the property, particularly in favour of the 2<sup>nd</sup> defendant.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom
