In 2003 he was seconded to the Ministry of Education to drive the Head of ICT unit of the Ministry when it embarked on a special programme.<o:p></o:p>&nbsp;<o:p></o:p>His duties involved "driving the Head of the Unit and other staff in the performance of their official duties which often run far beyond normal closing hours."<o:p></o:p><o:p>&nbsp;</o:p>He alleged also that drivers of the Ministry who perform similar duties with the Ministry's buses to convey staff to and from work were paid special overtime allowance<o:p></o:p><o:p>&nbsp;</o:p>Petitioner further stated that he claimed what he termed T&amp;T from Accra to Odumase at weekly rate of GH€5.00 amounting to GH¢1,440 which was also denied him.<o:p></o:p><o:p>&nbsp;</o:p>The Case of the Respondent:<o:p></o:p>A written response to the Petitioner's claim, in a letter Ref E.A. 22/264/01 dated 20th September, 2012 to the NLC, Respondent stated that:<o:p></o:p>v&nbsp; “The Complainant is not and never has been a staff in the employment of government posted to the Ministry of Education in any capacity or grade."<o:p></o:p><o:p>&nbsp;</o:p>v&nbsp; “The Complainant has not at any material time been assigned a duty by any officer of the Ministry of Education."<o:p></o:p>v
