text-align:justify;text-indent:-.5in;line-height:115%"><i><span style="font-family:"Book Antiqua",serif">4 <b>Perpetual injunction restraining the 1<sup>st</sup> and 2<sup>nd</sup> Defendants, their agents, servants and workmen from further encroachment on the plaintiffs’ undeveloped land at La Nkwantanang</b>.”<o:p></o:p></span></i></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua",serif"><o:p> </o:p></span></i></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">The plaintiffs/respondents (hereinafter referred to as respondents), in their statement of claim averred that under Executive Instruments (E.I.) 20 and E.I.17 of 1977 and 1991 respectively, the Government of Ghana acquired a large portion of their family’s land and reallocated same to Bank for Housing and Construction (B.H.C. for short), for housing projects to be sold to the Ghanaian public and that the identity and the boundaries of the plaintiff’s land were clearly shown in the said Executive Instruments.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">According to the respondents, no compensation whatsoever was paid to their family in respect of the lands compulsorily acquired under the said Instruments.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">It is the case of the respondents that in or around 1995, B.H.C. went into liquidation and the Lands Commission and the Land Valuation Board took advantage of the liquidation of the B.H.C. and started selling portions of these acquired lands to individuals and organizations. To vindicate their rights, the respondents claimed that Nii Amon Koteyfio, the then Chief of La Nkwantanang caused a Writ of Summons to be issued against the Lands Commission, Land Valuation Board, the Attorney General and the B.H.C. in a suit numbered L366/98, claiming inter alia, a fair, prompt, reasonable and adequate compensation or repossession of respondents’ land acquired under the said Instruments.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">The respondents further averred that the Attorney General and other agencies of Government having custody of Government lands defended the action. And by its judgment dated 30 January, 2004 the High Court, Accra, presided over by Nana Gyamera Tawiah J. ordered that the plaintiffs therein were to take <b>immediate repossession of the remaining undeveloped portion of the acquired land </b>since part of the land had been granted to private individuals and organizations contrary to and for the purpose for which the land was acquired in 1997. <o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">The respondents stated in their stateme
